Welcome to the website and online booking platform for Spirit Empire LLC in New Orleans, Louisiana. By accessing our site and booking French Quarter walking tours, haunted tours, history tours, food tours, or other services, you agree to be bound by these terms and conditions and applicable laws.

Reservations & Bookings

Online or phone reservations with Spirit Empire LLC constitute a legally binding agreement. You will receive a confirmation email containing your reservation details, tour information, payment due (if applicable), and a copy of these terms and conditions for your records. Full or remaining payment must be rendered upon tour check-in before the tour commences. You must be 17 years old to participate without a parent or guardian.

Payments & Fees

We accept all major credit cards and online payment platforms for deposits and final tour payments. The customer is responsible for any credit card transaction fees, bounced check fees, or failed electronic debit fees associated with your booking payments. Any cancellations, date changes, or amendments to your reservations will incur processing and change fees outlined in our policies below. No cash or credit card refunds can be given for any unused portion of tours and services during a tour.

Company Cancellations & Changes

Suppose Spirit Empire LLC must cancel or alter a tour due to inclement weather, vehicle issues, logistical problems, or other unforeseen circumstances. In that case, we will try to accommodate you on another available date or tour option. If no alternative tour date is suitable or available, you can receive a full refund of your payment. Spirit Empire, LLC cannot be held responsible for any additional costs you may incur outside of our tour fees about a cancellation or change.

Customer Cancellations, Changes & Refunds

We offer a 100% money-back guarantee if you complete the entire tour yet feel it did not meet expectations, contingent on not leaving negative reviews regarding your experience. To qualify for a refund:

• You must participate in the tour's entirety

• You may not leave negative feedback or reviews on any public platform. Doing so before or after a refund forfeits eligibility.

• Email info@spiritempire.com within 24 hours of the tour ending to request the refund and explain why you feel the tour failed expectations.

• If we have issued a refund that later becomes invalid due to a violation of the above, such as leaving negative reviews, you will have breached our refund agreement and be subject to legal action. Please get in touch with us first to resolve any issues before posting reviews.

Separate Cancellation Policy If canceling in advance

• 24 hours notice: Full refund

• Under 24 days: No refunds issued

• Any cancellation or date change requests must be made directly by emailing info@spiritempire.com. Written notification is required. No refunds are offered once tours commence.

Special Requests & Requirements

Please inform us when booking or email info@spiritempire.com regarding any special access requirements, dietary restrictions, medical conditions, or anything else we should know about to ensure your comfort, safety, and enjoyment during your tour. We make every effort to reasonably accommodate special requests received at least seven days before the scheduled tour date. Still, we cannot guarantee that all circumstances or needs can be addressed.

Code of Conduct

We expect all tour guests to act responsibly by not becoming disruptively intoxicated from alcohol consumption during tours, following all safety guidelines, procedures, and tour guide directions, and showing courtesy and respect towards all fellow tour participants, guides, venue staff members, and bystanders. Spirit Empire LLC reserves the sole right to remove any individuals from a tour at any time without refund due to unreasonable behavior, intoxication, disregard for policies/rules, or any other disturbances.

Limitation of Liability

You acknowledge that walking, history, and haunted tours may have certain risks and dangers due to the inherent nature of walking tours. This includes but is not limited to uneven sidewalks and pavement, proximity to traffic, inclement weather conditions, restricted lighting and visibility at night, loud noises, and tight spaces within buildings. Therefore, you release Spirit Empire LLC and its partners from all liability for indirect or consequential damages and agree that our maximum liability is limited to the fees you paid for tour services, excluding additional travel expenses. For this reason, we strongly encourage customers to consider purchasing travel insurance plans through recommended third-party providers.

Photography & Video Release

Photos, videos, and audio recordings captured by Spirit Empire LLC staff during tour activities may be used for future promotional materials, including but not limited to print ads, social media, website media galleries, demo reels, and professional portfolios, without liability or compensation to those included within the footage, still images or audio. Tour participation implies consent.

Data Privacy Policy

The personal information we collect directly from you through website forms, email communication, and/or secure payment processing partners is exclusively used to correspond with guests about their tour reservations and experiences. Collected information and data can include but may not be limited to your name, billing/shipping address, email address, phone number, and basic billing details used for payment processing. We will never sell, share, or distribute your data or personal information to outside companies or organizations for unrelated usage unless required by law.

Competitor Exclusion Policy

Members, officers, employees, and affiliates of competing tour companies operating ghost tours, haunted tours, paranormal tours, or any walking tours whatsoever in the Greater New Orleans area are strictly prohibited from purchasing tickets for, attending, or participating in any tours offered by Spirit Empire LLC.

This exclusion policy applies to anyone affiliated as staff, contractors, freelancers, or volunteers with identified competitor tour operators within proximity of New Orleans. Any violation of this competitor exclusion clause is legally subject to the maximum financial penalties outlined in our arbitration agreement and dispute resolution policy. Guest participation and ticket purchases are closely monitored across providers.

Dispute Resolution

Any legal disputes or claims associated with these terms, our website, online reservations system, or tour experiences must first attempt to be resolved by contacting management directly for an adequate resolution or settlement. Suppose a satisfactory resolution cannot be reached through direct dialog. In that case, any outstanding matters must be resolved via binding arbitration through the American Arbitration Association commercial rules in New Orleans, Louisiana, rather than through regular court lawsuits. Agreeing to these terms and conditions and choosing to book services with us after reading this Agreement constitutes your acceptance of these terms and limitations.
